1. About GoVybe

GoVybe, Inc. ("GoVybe," "we," "us," or "our") operates a community-based rideshare platform that connects riders with independent drivers through a mobile web application. GoVybe is a technology platform — we do not provide transportation services directly and are not a transportation carrier.

Drivers on GoVybe are independent contractors, not employees of GoVybe. GoVybe does not control how drivers operate their vehicles or conduct rides beyond the standards set forth in these Terms.

2. Eligibility

To use GoVybe you must:

• Be at least 18 years of age
• Have a valid phone number in the United States
• Have the legal capacity to enter into a binding agreement
• Not have been previously removed from the GoVybe platform

Drivers must additionally:

• Hold a valid driver's license in the state where they operate
• Carry valid auto insurance that meets or exceeds state minimum requirements
• Own or have legal authority to operate the vehicle used for rides
• Pass GoVybe's background check and identity verification
• Be invited by an existing GoVybe rider and complete a verification ride

3. Accounts

Account Creation

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Account Security

Notify us immediately at [email protected] if you believe your account has been compromised. GoVybe is not responsible for losses resulting from unauthorized account access caused by your failure to keep credentials secure.

One Account Per Person

Each person may maintain only one GoVybe account. Creating multiple accounts to circumvent suspensions or other restrictions is prohibited.

4. The GoVybe Platform

For Riders

GoVybe allows you to request rides from drivers you have saved or who are available in your area. By requesting a ride you agree to:

• Be ready at your pickup location at the scheduled time
• Treat drivers with respect and courtesy
• Pay the agreed fare plus any applicable fees
• Not request rides for illegal purposes
• Not bring illegal substances, weapons, or animals (unless agreed with the driver)

For Drivers

GoVybe allows drivers to set their own rates and keep 100% of fares earned. By driving on GoVybe you agree to:

• Maintain a safe and clean vehicle at all times
• Hold valid insurance coverage for rideshare or commercial driving
• Follow all applicable traffic laws and regulations
• Treat riders with respect and professionalism
• Only accept rides you are capable of completing safely
• Not drive while impaired by alcohol, drugs, or fatigue
• Complete the verification ride requirement before driving independently

Invite-Only Driver Access

Driver accounts are invitation-only. A prospective driver must be invited by an existing GoVybe rider or driver and complete at least one verification ride before their driver account is fully activated. This system exists to maintain community trust and safety standards.

5. Payments

Fares

Drivers set their own rates on GoVybe. Fare estimates are displayed to riders before a ride is confirmed. Final fares are based on actual distance and time, plus any additional fees agreed upon.

Payment Processing

Payments are processed securely through Stripe. By using GoVybe you agree to Stripe's Terms of Service. GoVybe does not store full payment card details.

Driver Earnings

Drivers receive 100% of fares paid by riders. GoVybe does not take a commission on rides. GoVybe may introduce optional paid features or subscriptions in the future with advance notice.

Refunds and Disputes

Fare disputes must be submitted within 24 hours of the completed ride. GoVybe will review disputes and may issue refunds at our discretion. We reserve the right to adjust fares in cases of clear error.

6. Ratings and Reviews

Both riders and drivers may rate each other after a completed ride. Ratings must be honest and based on your actual experience. GoVybe may remove accounts with consistently low ratings or review patterns that indicate abuse of the rating system.

7. Prohibited Conduct

You may not use GoVybe to:

• Violate any applicable law or regulation
• Harass, threaten, or discriminate against any user
• Provide false information during registration or verification
• Impersonate another person or entity
• Attempt to circumvent the invite-only driver system
• Use the platform to solicit rides or payments outside of GoVybe
• Interfere with the platform's technical systems
• Scrape, harvest, or collect user data without authorization
• Use the platform for any commercial purpose other than providing or receiving rides

8. Safety

The safety of our community is GoVybe's top priority. All users are expected to:

• Report safety incidents immediately via the app or at [email protected]
• In case of emergency, always call 911 first
• Wear seatbelts during all rides

GoVybe reserves the right to suspend or permanently remove any user whose conduct poses a safety risk to the community.

9. Intellectual Property

GoVybe and its logos, designs, software, and content are the intellectual property of GoVybe, Inc. You may not reproduce, distribute, or create derivative works from our content without written permission. You retain ownership of any content you submit to the platform but grant GoVybe a license to use it to operate and improve the service.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GOVYBE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOVYBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA.

GOVYBE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO GOVYBE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold GoVybe, its officers, directors, employees, and agents harmless from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.

13. Termination

You may delete your account at any time. GoVybe may suspend or terminate your account at any time, with or without notice, for violations of these Terms, safety concerns, or at our discretion. Upon termination, your right to use the platform ceases immediately.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any dispute arising from these Terms or your use of GoVybe shall be resolved through binding arbitration under the American Arbitration Association rules, rather than in court, except that either party may seek injunctive relief in court for intellectual property violations.

Class action waiver: You agree to resolve disputes with GoVybe individually, not as part of a class action.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email at least 30 days before they take effect. Your continued use of GoVybe after changes take effect constitutes acceptance of the updated Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoVybe regarding your use of the platform and supersede all prior agreements.
